BOOKING TERMS & CONDITIONS
Our standard terms and conditions apply in full to all bookings and comply with National Consumer Agency guidelines and EU Distance Selling legislation.
We may from time to time accept a booking subject to additional or substituted terms, in which case you will be advised of these as part of your quotation and given them in writing as part of your booking confirmation. By making payment of a deposit you will be deemed to have read and agreed to these terms prior to booking.
If you have booked for a group you are deemed to have accepted these terms and conditions on behalf of all members of your party. Voucher Holders should refer to different terms sent with their voucher and accessible to view on the gift voucher page of our website www.odd.ie

Booking terms
Group Size
At the time of booking you will be asked to confirm the number of persons you wish to book for. Minimum group size may apply, which will be specified on your booking confirmation. Reduced numbers between booking and arrival may result in loss of discount or other benefit if offered and accepted subject to minimum numbers. In most instances it will be possible to increase your numbers at short notice. However where bookings are confirmed for a party of 10 persons or less, other parties may be added to the same activities.
Payment
At the time of booking you will be asked to confirm the number of persons you wish to book for. Minimum group size may apply, which will be specified on your booking confirmation. In most instances it will be possible to increase your numbers at short notice. As the person making the booking you are responsible for payment in full. However if we agree to accept another person's card details, or more than one card for payment of deposit, the card holders will be deemed to be joint parties to the booking, and to have agreed to use of their card as per our terms and conditions. We reserve the right to charge the card/s without further notice for late cancellation, no show, or failure for any reason to pay full balance due on arrival.
For large bookings we may accept deposit payments in several instalments, each payment being automatically deducted from the same card on a pre-agreed date. Once the full deposit has been received the booking will be confirmed. We regret failure to make all payments may result in cancellation of your booking without refund.
Payment methods
We will accept payment of a deposit by cheque subject to also being given credit or debit card details to hold as security against late cancellation. Balance may be paid by credit or debit card, bankers draft, postal order or cash. Please note we are unable to accept cheques for payment of a balance, or to offer credit facilities.
Booking Confirmation
On receipt of your deposit we will send you written confirmation by email of your booking and payment made, a copy of these terms and conditions, and any additional or substituted terms you were advised of verbally prior to booking. Please read through all documents immediately upon receipt and seek clarification if any part is unclear. You may notify us within 48 hours of sending documentation if you then wish to cancel and obtain refund. Thereafter you will be deemed to have received, read and agreed to all terms and conditions and details of the booking, and standard cancellation terms below will apply.
Changes to your booking - by you
We will accept one change of date, time, or activity subject to availability and a minimum of 28 days notice. Any additional changes, if accepted, will be subject to a €25 administration fee
Changes to your booking - by us
For safety reasons we reserve the right to change the format of an activity without notice, which may differ from a description or image. On occasion we may not be able to provide the activity, and in such instance will offer alternative activities. If an alternative activity to Rage Buggy Rally, Hovercraft Grand Prix or clay pigeon shooting is not acceptable you may rebook an alternative date or request refund of your deposit. We reserve the right to change all other activities without notice or refund for another of equal or higher value when necessary. Special offers may have an alternative activity listed as a condition of the offer.
Cancellation Policy: If you cancel with

Deposits will not be refunded for cancellation or offset against reduced balance if some of your party cancel. - 14 to 8 days notice
Deposit will be lost and a cancellation charge equivalent to 50% of any balance due will be applied if the entire booking is cancelled. - 7 days notice or less
Reduced numbers: Notice of any final reductions in group size must be received by us no later than 7 days before the event, as shown on your booking confirmation letter. No further reduction to your balance will be made after this cut-off date. The balance will not be adjusted to lower numbers on arrival. Reduced numbers may also affect the terms offered. Please refer to first paragraph above regarding Group Size
Cancellation, No Show or equivalent: A cancellation charge equal to the full outstanding balance based on the group size as notified to us seven days or more before the event will be charged in full to the card/s supplied as security.
Cancellation by us
If for circumstances beyond our control we have to cancel your event you will be notified as early as possible and offered a full refund or an alternative date. However we regret we're not able to reimburse travel, accommodation or other costs incurred by you for an experience that is cancelled for any reason, nor can we guarantee any minimum notice of cancellation.
Late Arrival
Please arrive 30 minutes before your start time. Start time is the time agreed at booking, not the time your party arrives. We regret your activity time will not be extended, nor any reduction in price made if your activity time is reduced because your party is late. Ensure you have allowed adequate travelling time, including the ten minute drive from Ballyconnell to the Gamespark itself.
For health and safety reasons, persons arriving late may not be able to join an activity if they have missed the safety briefing or tuition has commenced. Voucher holders arriving late or failing to arrive will be deemed to have forfeited the entitlements of their voucher.
Dangerous Behaviour and/or Damage
ODD reserve the right to cancel your party's activity or remove individuals without refund if inappropriate, dangerous, malicious, persistent or deliberate misbehaviour occurs within the group. The cost of repair for any damage caused to property or equipment, either deliberately, or as a direct consequence of misbehaviour will be charged to the credit card of the person who made the booking.
Exceptional Circumstances
Discretionary exceptions to the above terms and conditions may be made in exceptional circumstances; evidence of such circumstances may be requested.
General Information
Weather - our activities run in most weather conditions. If in doubt you are welcome to phone and check before travelling, but unless we contact you to reschedule you should assume your event is running. We regret we cannot offer a fixed number of hours advance notice of postponed or changed event times.
Clothing - Wear adequate clothing and footwear for an out door event, suited to the time of year, and the weather conditions on the day. While we do supply wet gear and wellies, we do suggest you have your own in case they are not available in your size. Bringing a change of clothing is also advisable.
Be on time - see terms and conditions Start time is the time agreed at booking, not the time of arrival. The later your group arrives, the shorter your remaining time slot will be. For health and safety reasons, individuals arriving late will not be able to join an activity if they have missed the safety briefing or tuition has commenced.
Age restrictions - you must be aged 15 to take part in Rage Buggy or Rage packages, and tall enough to have full control of foot pedals. Minimum age is 16 for our Hovercraft Experience. All other activities are aged 10 and over, accompanied by an adult participant. All persons under the age of 18 will need the signature of a parent or legal guardian on disclaimer in order to take part.
Parking - is entirely at your own risk. Keep your vehicle locked. Valuables - Don't bring jewellery or valuables with you. We do not accept any responsibility for loss or damage. Pets - please don't bring any. Guide dogs excepted.
Insurance - Gamespark Ltd., t/a Out Doors and Dirty carries full liability insurance.
Spectators - we welcome spectators of any age, subject to adult supervision of under 18s at all times. If you are booked for an event which does not include your youngsters, please have a spare adult with you for supervision purposes!
Off limits - May we respectfully remind you that any vehicles or equipment set out for an event, and course areas beyond fencing or tape are strictly off-limits to spectators of all age groups!
Alcohol - Alcohol is not permitted at the Gamespark. If you appear to be under the influence of alcohol or any other substance on arrival or during your visit you may be refused entry or requested to leave, and your booking cancelled without refund.
Health - Please notify your Marshall on arrival of any medication, illness, special needs, disease or condition suffered by you or another person in your party which could affect personal safety or the safety of others. All such information will be treated in strictest confidence.
In certain instances height and weight restrictions may also apply. Where we consider an activity unsuitable for any member of your party we sincerely regret we have no option but to exclude them from the activity, and refund them.
Weight restrictions - Hovercraft weight limit is 18 stone. Buggies can accommodate up to 20 stone; you will have to able to climb in and out through a roll cage. In all instances participation is subject to wearing a crash helmet - We have up to size XXL available.
Courtesy - please be nice to our Marshalls! If they make a request of you it will be with your safety, and the safety of others in mind, so please comply. We want all of you to have a great time, so please be nice to each other and considerate of other groups at the park.
Descriptions - All written, visual or verbal description of the activities, equipment, duration, facilities etc. is offered as a guide only. While every effort is made to supply the experiences as described, we reserve the right without prior notice to amend, alter or restrict any activity in the interest of your safety or that of our staff. While we regularly check that written descriptions offered by a third party seller are accurate, we cannot guarantee that all verbal or written information supplied by them or others is correct. You are welcome to contact us directly for information.
Duration of Event - The number taking part in your event can vary which directly determines the overall duration time of the event. However your personal activity and /or number of laps offered in a description or booking confirmation is unaffected. 'Event' is deemed to be a 'Hovercraft Grand Prix' or 'Rage Buggy Rally' where you are competing with others and may be waiting for others to complete their activity in order for all competitors lap times to be compared and finalists confirmed.
Weekend Break Start times and Duration - The start times of activities can vary depending on prior bookings at ODD or weather conditions. Please allow for the possibility of activities taking place on Sunday mornings as well as, or in place of, Saturdays. The number taking part in your event does vary which directly determines the overall duration time of the event. However your personal activity and /or number of laps offered in a description or booking confirmation is unaffected.
Location - refer to our map Ballyconnell is our postal address, and is the nearest town to the Gamespark. The Gamespark is in a rural location, ten minutes drive from the centre of Ballyconnell, passing through the village of Bawnboy. When calculating travelling time please allow for this.
Prices - ODD reserves the right to alter prices without notification although any changes will be highlighted at the time of purchase.
Disclaimer - on arrival, and before any event commences, we will ask you to read and sign a disclaimer. A copy is attached. If you are booking on behalf of a group you should ensure these notes, disclaimer and our terms and conditions are made available to all members. If your party includes minors aged under 18 they must bring with them a disclaimer signed by parent or guardian in order to take part in any activity. Where we have been made aware of minors we will issue adequate disclaimers for signature in advance of your party's arrival.
Facilities - as an ongoing development, some facilities at the Gamespark may not be fully completed prior to your arrival. If so, please excuse our appearance. Your event or your safety will not be impaired.
Photographs - You are welcome to take photographs of your group for personal use during your day at the Gamespark, provided you keep within the activity safety zones and are aware we accept no liability for loss or damage to your camera/video/phone/whatever. We welcome receiving images and comments or u-tube links from you of your day at ODD, for inclusion on the Gallery. No photographs may be reproduced or used for commercial purposes without prior consent.
Web site links - are offered to assist you. We are making no recommendation of any business or product by including a link to their site, and we take no responsibility for the accuracy or suitability of the content. Tell us about other links which might be useful.
Complaints - we will always try to ensure you won't have any, but if you do it is essential you bring your complaint to the Marshall running your event immediately. If they cannot rectify the problem there and then they will ask you to make your complaint in writing, for the attention of Customer Services, The Gamespark, Brackley Lake, Ballyconnell, Co. Cavan. You will receive a prompt response.

DISCLAIMER
Gamespark Ltd, t/a ODD and Out Doors and Dirty are the providers and operators of The Gamespark and all ancillary equipment. You are asked to read this document carefully, prior to joining any activity, and sign and date it at the bottom as confirmation that you have read, understood and accept the contents. If you are unsure about any or all items you should ask for clarification before signing. You should not sign if you have any concerns, but we regret we cannot allow you to participate in those circumstances. A copy of this disclaimer will be forwarded to you on request, provided you have added your address to the bottom of the form at the time of signing.
Gamespark Ltd, its' Marshalls and all other staff
- Will undertake to provide all participants with an enjoyable activity, subject to the safety and well being of everyone. Safety equipment/clothing will be provided, and you are required to use/wear it. Failure to make use of the equipment provided or to use it improperly will result in your being unable to participate. You are asked to inform a Marshall immediately if you believe any equipment supplied to you is damaged or faulty, so replacement items can be provided.
- Will provide safety briefings and training prior to the commencement of each activity. You are asked to give these your full attention, and comply with all/any instructions given. If you have any doubts regarding the usage of the equipment or any instructions given you must inquire from the Marshall & seek full clarification before embarking on any activity. Since the rough terrain and physical nature of these activities does incur a risk of injury you should be aware that participation in all activities is entirely at your own risk. We do not accept responsibility or liability for any injury, loss or damage howsoever arising whether caused by your own actions or the actions of others. All participants are recommended to have adequate personal accident insurance in place for all such activities/pursuits.
- Will not be held responsible for any theft or loss of property while you are here. All valuable items should be left at home and all vehicles should be locked and secured. Use of the car park is entirely at your own risk and Gamespark Ltd and staff accept no responsibility for theft, loss or damage howsoever arising to vehicles, persons or property whilst on the premises.
- Will not permit alcohol/drugs on the premises, nor permit you to participate if you appear to be affected by same. You will not be entitled to any refund if you are refused admission as a result.
- It is an express requirement of participation in the activities that all persons participating in the activities/pursuits or persons in the role of parent, guardian or carer of persons intending to participate in any pursuits/activities notify the Marshall of any medication, disability (mental/physical) illness, disease or medical condition of which you have suffered or complained of that could in any manner affect your safety or the safety of others or in any manner, shape or form impair your ability to participate in such activities/pursuits.
- Will ask you to keep long hair tied securely, to remove jewellery/scarves and to wear practical and suitable clothing and footwear, suited to the time of year and outside conditions. Gamespark Ltd will provide adult size wet gear on request.
- Will cancel your group's activity without refund if inappropriate, dangerous, malicious, persistent or deliberate misbehaviour occurs. For your own safety, and in consideration of our neighbours and other participants, you are asked to keep within the boundaries of the park, and within activity waiting areas which shall be marked by fencing, tape or similar demarcation until called forward. Please keep to paths, respect any notices regarding access and do not drop litter.
- May on occasion without prior notice have to change /amend the activities booked, if weather conditions, equipment failure or other unforeseen difficulties arise, as per terms and conditions accepted on booking. We also reserve the right to refuse admission.
